The opinion of the court was delivered by This is a direct appeal from an order of the district court summarily denying the claim of Mary Sprague, as administrator of the estate of Homer D. Fox, against the estate of Bryan J. Gallatin. In 1967 Gallatin and Fox were owners of equal interests in oil and gas leases. Fox operated the leases and paid the bills. He in turn billed Gallatin for his share of the expenses. Each party collected his own share of the production proceeds. This arrangement continued until Gallatin died on March 27, 1970.
